Establish a working relationship with GymSmarts.com; a leader in the gymnastics training DVDs. Place a link to GymSmarts shopping cart on your website and earn money based on purchases. Affiliate Agreement
This agreement is made between GymSmarts.com, a division of TRB Design, Inc. and you, the affiliate partner. By filling out the sign-up form you acknowledge that you have read the terms and conditions, understand, and agree with them.
1. Joining the Program
All products sold on GymSmarts.com web-site are available for commission. Commission amounts are based on net price (less tax and shipping charges) of products sold. Commission will be paid quarterly (March, June, September, and December) by the 15th of each month to all affiliates with a balance of $25 or more of commissioned sales. For those with less than $25 worth of commissioned sales their balance will be held until $25 is accumulated. At that point we will mail the check to the address provided to us upon your registration with the affiliate program.
By filling out the signup form you will automatically become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referral individuals.
2. Affiliate Links
You may use graphic and text links both on your website and in emails. The site may also be advertised "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to the conditions set forth by GymSmarts.com.
3. Affiliate Tracking
Each Affiliate will have their own secure location on the GymSmarts.com server where they can view, at any time, a summary of commissions earned for customers that used the qualifying link located on their site. All orders must be placed online through your affiliate link. Users must stay within site once the user clicks through your affiliate link. GymSmarts can not assure that credit will be given if the user browses to other sites and then returns to make purchase. Directly surfing to http://www.GymSmarts.com will not record credit, the user must use the uniquely rendered affiliate link which will be provided to you upon registration. Credit will not be recorded for orders made through phone, or fax, however you may always call us at 781.987-1655 to ask questions before ordering.
4. Terms of the agreement
These terms will begin upon your sign-up with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by us at any time. If any modification to the terms is unacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.
5. Liability
We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors.
Affiliates hold no connection to the opinions and standards held by GymSmarts.com therefore an affiliate may not speak on behalf of or act as a representative of GymSmarts.com. An affiliate does not have the right to promise discounts, rewards, shipping times, returns, company decisions, or any other rights held by GymSmarts.com. The affiliate status is solely the ability to make a commission on purchases made by those persons buying items through the affiliate link.
6. Revocation of Affiliate Status
Accreditation is based entirely upon the discretion of GymSmarts.com. Membership may be revoked at any time by GymSmarts.com, upon termination a written statement will be provided to you either by standard or electronic mail. Basis for termination may include fraudulent use of affiliate status, displaying lewd or indecent content along side affiliate banner, speaking on behalf of GymSmarts.com, and other isolated instances. In some cases such as fraudulent and unethical use the user's credit will be forfeited.
Affiliates may cancel at any time by logging into their affiliate administration page and selecting op out. Upon cancellation a check encompassing the final balance will be mailed to the affiliate's address on file with GymSmarts.com.
7. Cancellation and Affiliate Information
Affiliates are also responsible for updating their own contact information from this Affiliate administration page. Incorrect information may result in checks not being mailed or being mailed to errant addresses.
Upon agreeing to the affiliate program the individual charged with administering the program agrees to the terms of service mentioned above and is solely responsible for the accordance with these standards. Any questions regarding these terms of service may be directed to affiliate@trbdesigns.com
